Terms of Service

1. Description of Service

Yomi is an image-processing software. The Service provides a cloud-based, browser-accessible tool for the automated extraction, removal, translation, and overlay of text layers within raster image files. Core capabilities include: (a) optical character recognition (OCR) to detect and extract embedded text from uploaded images; (b) AI-powered in-painting for non-destructive removal of source text and background restoration; and (c) multilingual translation layer generation for overlaying translated text onto processed image assets.

The Service operates strictly as a utility for processing image files supplied by the user. Yomi does not generate, curate, publish, or distribute any content. All images processed through the platform are user-supplied and remain under the user's sole ownership and responsibility.

2. User Conduct and Responsibilities

Your use of the Service is subject to all applicable local, national, and international laws and regulations. You agree not to use Yomi for any unlawful purpose or in any way that could harm the Service, its infrastructure, or other users.

• User Responsibility for Uploaded Content: You are solely responsible for the images you upload for modification. You represent and warrant that you hold all necessary rights, licenses, and permissions to process any visual materials using the Service. Yomi assumes no liability for the legality or appropriateness of user-uploaded content.
• No Hosting or Distribution of User Content: The platform does not host, share, or distribute any user-uploaded content. Image assets processed through Yomi are used exclusively for the purpose of providing the requested processing functionality and are not made accessible to any third party.
• Prohibited Use: You may not use Yomi to process content that infringes third-party intellectual property rights, violates applicable law, or is otherwise harmful, defamatory, or obscene. Yomi reserves the right to suspend or terminate accounts found to be in violation of these restrictions.

3. Intellectual Property of Yomi

All software code, interface design, branding elements, logos, trademarks, and proprietary features of the Yomi platform are the exclusive intellectual property of Yomi and are protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal or internal business purposes, subject to these Terms and your active subscription. No other rights in or to the Service are granted to you.

4. Subscriptions and Payments

Access to the Yomi Service is provided on a subscription basis. Subscription fees are charged monthly or annually, as selected at the time of purchase. All fees are stated in USD and are exclusive of applicable taxes.

Subscriptions renew automatically at the end of each billing period unless cancelled prior to the renewal date. You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain full access to the Service through the end of your current paid billing period. Refunds for the active billing cycle are not provided.

5. Third-Party Services and Payment Processors

The Service may integrate with or reference third-party services, including payment processors. These third-party providers operate under their own terms of service and privacy policies, which are independent of Yomi.

Yomi is not responsible for the practices, availability, or content of any third-party services. The inclusion of any third-party integration does not constitute an endorsement by Yomi.

6. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the maximum extent permitted by applicable law, Yomi shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Service, even if Yomi has been advised of the possibility of such damages. You agree to indemnify, defend, and hold harmless Yomi and its affiliates from any claims, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

7. Term and Termination

These Terms take effect when you create a Yomi account or first access the Service, and remain in effect until terminated.

Yomi reserves the right to suspend or terminate your access to the Service at any time and without notice in the event of a violation of these Terms, abuse of the platform infrastructure, or as required by applicable law. In such cases, Yomi shall have no liability to you for such suspension or termination.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or the Service shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to the competent courts of the jurisdiction where the Service operator is registered.

9. Miscellaneous

Yomi may assign these Terms or any rights hereunder without restriction. You may not assign your rights or obligations under these Terms to any third party without Yomi's prior written consent.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and Yomi with respect to the use of the Service and supersede all prior agreements.
